Men accused of stealing from The Home Depot waive pre-trial
ALPENA –The two Florida men accused of allegedly stealing from The Home Depot in Alpena waived their pre-trial, sending their case over to the circuit court.
Arsen Caballero and Yandriel Hernandez are both facing several charges regarding the alleged theft including retail fraud in the first degree and receiving and concealing stolen property for $20,000 or more.
According to Caballero’s attorney Elias Muawad, Caballero waived the pre-trial in his case on Tuesday. Hernandez’s attorney Richard Steiger, said that Hernandez waved his on Wednesday.
Both cases are now bound over to the circuit court. Muawad claims that Caballero is looking to see this case resolved, with Muawad stating that he personally does not expect this case to go to trial.
“He wants to resolve it,” Muawad said about his client Caballero. “I just can’t see this case going to trial. Hopefully, we can resolve it short of trial.”
According to Steiger, Hernandez’s next court appearance has been tentatively set for Aug. 5.
Hernandez and Caballero were arrested on June 1 for allegedly stealing power tools from The Home Depot in Alpena, according to a press release from the Alpena County Sheriff’s Office.
The two allegedly stole a large amount of power tools and left the store. The two suspects were last seen by an employee witness at The Home Depot who followed the suspects going westbound on M-32 until they reached the area of Indian Reserve Road where the employee discontinued.
Officers from the Alpena County Sheriff’s Office and Michigan State Police searched the area until a sergeant with the Sheriff’s Office located the vehicle on M-32 near Jacks Landing Road in Green Township.
The officer discovered $34,960 worth of power tools allegedly stolen from six different The Home Depot locations in Michigan as well as $2,200 in merchandise allegedly stolen from TJ Maxx in Saginaw. The U.S. Border Patrol assisted the sheriff’s office in identifying the subjects and MSP assisted on the scene, according to the press release.
